The Primary Data Region, the principal location where Customer personal data is hosted, is the United States unless another location is expressly agreed in writing. Other regional arrangements may be available on request and may involve additional fees. Choosing an alternative Primary Data Region concerns primary hosting only. It does not mean that all processing, backups, support, administration, security operations, or authorized access occur only in that region. Customer personal data may be accessed from the United States, Italy, Chile, or another location disclosed in the agreement, current provider disclosures, or a written transfer notice, when authorized personnel or an approved Subprocessor performs an essential function. Such access must be necessary for the assigned function and is subject to confidentiality, role-based access, logging, and applicable transfer safeguards. Where an international transfer requires a specific legal mechanism, the parties use an applicable mechanism recognized by law.
