Who decides what action should be taken after a result?
Qualified personnel apply the organization’s procedures; OPTOVERA does not decide the action.
The organization decides what action should be taken after an OPTOVERA result.
OPTOVERA provides an objective readiness signal based on the User’s pupillary response compared with the User’s individual baseline. The result is intended to support review, but it does not make decisions and does not determine what action should be taken.
Supervisors, safety teams, occupational health personnel, or other qualified personnel should review the result according to the organization’s internal policy, safety procedure, and applicable legal requirements.
Under the OPTOVERA Terms of Service, the results, indicators, and alerts generated by the Service, defined there as Readiness Information, are for preventive safety use only. They must not be used to evaluate individual productivity or work performance, as evidence of misconduct, impairment, or intoxication, or as evidence supporting disciplinary action or termination of employment. OPTOVERA must not be used to make an automated decision producing legal, employment, or similarly significant effects on a User.
This does not prevent temporary protective measures, such as a confirmation measurement, temporary restriction from safety-sensitive activities, temporary reassignment, or additional safety review, where permitted by law and supported by qualified human review. Such measures are not disciplinary findings.
Any follow-up action, such as additional review, temporary reassignment, escalation, or return to work, remains the responsibility of the organization and should be handled through its defined procedures.
